Uganda’s constitutional court has rejected a bid to overturn a controversial anti-gay law that is considered one of the toughest in the world.

“We decline to nullify the Anti-Homosexuality Act 2023 in its entirety, neither will we grant a permanent injunction against its enforcement,” Justice Richard Buteera, Uganda’s deputy chief justice and head of the court, said in the landmark ruling.

The legislation was adopted in May last year, triggering outrage among the LGBTQ+ community, rights campaigners, the UN and western nations.

The Anti-Homosexuality Act imposes penalties of up to life in prison for consensual same-sex relations and contains provisions that make “aggravated homosexuality” an offence punishable by death.

President Yoweri Museveni’s government has struck a defiant tone, with officials accusing the west of trying to pressure Africa into accepting homosexuality.

The petition was brought by two law professors from Makerere University in Kampala, legislators from the ruling party and human rights activists.

They had charged that it violates fundamental rights guaranteed by Uganda’s constitution, including freedom from discrimination and the right to privacy.

The petitioners also said it contravened Uganda’s commitments under international human rights law, including the United Nations convention against torture.

The court had begun hearing the case in December.

A 20-year-old man became the first Ugandan to be charged with “aggravated homosexuality” under the contested law in August last year.

He was accused of “unlawful sexual intercourse with … (a) male adult aged 41”, an offence punishable by death.

Uganda, a conservative predominantly Christian country in east Africa, is notorious for its intolerance of homosexuality. It has resisted pressure from rights organisations, the UN and foreign governments to repeal the law.

The US, which threatened to cut aid and investment to Kampala, imposed visa bans on unnamed officials in December for abusing human rights, including those of the LGBTQ community.

The World Bank announced in August it was suspending new loans to Uganda over the law, which “fundamentally contradicts” the values espoused by the US-based lender.

In December, the Ugandan state minister for foreign affairs, Henry Okello Oryem, accused the west of seeking “to coerce us into accepting same-sex relationships using aid and loans”.

In 2014, international donors slashed aid to Uganda after Museveni approved a bill that sought to impose life imprisonment for homosexual relations, which was later overturned.

Imagine that the United States sanctions countries that refuse to do man-on-man anal.

Uganda’s Finance Ministry said on Monday that it plans to borrow $150 million from the Export-Import Bank of China (ExIm) to develop the country’s Internet infrastructure.

Uganda would normally fund such projects through the World Bank, its primary development lender, but the World Bank halted loans to Uganda after President Yoweri Museveni signed the Anti-Homosexuality Act in May.

We’ve known that every Western globalist institution has a policy of forcing countries to do fisting and even double fisting with men, but it’s important to take a step back and just consider how bizarre that is.

The World Bank suspended funding for Uganda in August, pending “additional measures” that could soften the Anti-Homosexuality Act.

The Ugandan law created a new category of crimes called “aggravated homosexuality” that merit severe punishments, originally including the death penalty, although Museveni purportedly loosened the death sentences slightly before signing the bill into law. He did not loosen them very much, as there is a capital case for aggravated homosexuality currently before Ugandan courts.

Homosexual conduct was already nominally illegal in Uganda before the new law. “Aggravated homosexuality” broadly means same-sex relations where one of the parties does not give full consent.

Many Western governments were appalled at the Ugandan law, including the Biden administration, and threatened sanctions unless it was repealed.

Biden is appalled that both faggots should have to give full consent.

“I want to inform everybody, starting with Ugandans, that Uganda will develop with or without loans,” Museveni declared in August.

“With discipline, patriotism and combating corruption, we shall thrive because our agriculture is there, our industries are growing and our services sector is expanding,” he vowed.

“It is therefore unfortunate that the World Bank and other actors dare to want to coerce us into abandoning our faith, culture, principles and sovereignty, using money. They really underestimate all Africans,” he said.

In April, Museveni urged other African nations to join Uganda in resisting “the promotion of homosexuality,” which he described as “a big threat and danger to the procreation of the human race.”

“Africa should provide the lead to save the world from this degeneration and decadence, which is really very dangerous for humanity,” he said.

Uganda’s President Yoweri Museveni on Thursday denounced the World Bank’s decision to suspend new funding in response to a harsh anti-LGBTQ law and vowed to find alternative sources of credit.

The country would have to revise its budget to absorb the move’s potential impact, a junior finance minister said.

The World Bank said on Tuesday that the law, which imposes the death penalty for certain same-sex acts, contradicted its values and that it would pause new funding until it could test measures to prevent discrimination in projects it finances.

A reminder that the law gives the death penalty only for faggots who sodomize children, cripples and retards, and for intentionally infecting your fellow faggot with a serious disease.

Museveni said that if Uganda needed to borrow, it could tap other sources, and that oil production expected to start by 2025 would provide additional revenues.

Uganda’s president has signed into law anti-gay legislation supported by many in this East African country but widely condemned by rights activists and others abroad.

The version of the bill signed by President Yoweri Museveni doesn’t criminalize those who identify as LGBTQ+, a key concern for some rights campaigners who condemned an earlier draft of the legislation as an egregious attack on human rights.

But the new law still prescribes the death penalty for “aggravated homosexuality,” which is defined as cases of sexual relations involving people infected with HIV, as well as with minors and other categories of vulnerable people.

Most other media outlets don’t even mention that the death penalty only applies for faggots having sex with minors, retards, or infecting people with HIV, they try to imply the government is just gonna kill faggots for being faggots.

A suspect convicted of “attempted aggravated homosexuality” can be imprisoned for up to 14 years, according to the legislation.

Museveni had returned the bill to the national assembly in April, asking for changes that would differentiate between identifying as LGBTQ+ and actually engaging in homosexual acts. That angered some lawmakers, including some who feared the president would proceed to veto the bill amid international pressure. Lawmakers passed an amended version of the bill earlier in May.

LGBTQ+ rights campaigners say the new legislation is unnecessary in a country where homosexuality has long been illegal under a colonial-era law criminalizing sexual activity “against the order of nature.” The punishment for that offense is life imprisonment.

The United States had warned of economic consequences over legislation described by Amnesty International as “draconian and overly broad.” In a statement from the White House later Monday, U.S. President Joe Biden called the new law “a tragic violation of universal human rights — one that is not worthy of the Ugandan people, and one that jeopardizes the prospects of critical economic growth for the entire country.”

“I join with people around the world — including many in Uganda — in calling for its immediate repeal. No one should have to live in constant fear for their life or being subjected to violence and discrimination. It is wrong,” Biden said.

The United Nations Human Rights Office said it was “appalled that the draconian and discriminatory anti-gay bill is now law,” describing the legislation as ”a recipe for systematic violations of the rights” of LGBTQ+ people and others.

Ugandan officials have banned a prominent LGBT rights group in a major setback for the community there.

Sexual Minorities Uganda (Smug) has been ordered to shut down with “immediate effect” for not registering properly with authorities.

The campaign group decried the order as a “clear witch hunt” by the government against LGBT Ugandans.

Sexual minorities face widespread persecution in Uganda, where anti-gay and transphobic views are common.

Gay relationships are illegal in Uganda, where they can be punished by up to life in prison for committing “unnatural offences.”

Official police data shows that 194 people were charged under the offence between 2017 and 2020, including 25 who went on to be convicted.

“This is a clear witch hunt rooted in systematic homophobia, fuelled by anti-gay and anti-gender movements,” said Smug’s director Frank Mugisha, who is a gay Ugandan activist.

He accused authorities of treating members of Uganda’s LGBT minority as second-class citizens and trying to erase their existence completely.

On Friday Ugandan officials announced they were halting Smug’s operations because the campaign group, founded in 2004, had failed to register its name with the National Bureau for Non-Governmental Organizations (NGOs) properly.

It is the same reason given last year when dozens of civil society groups – including pro-democracy organisations – were also banned by Ugandan authorities.

This time officials say that the issue stems from Smug’s name itself – Sexual Minorities Uganda.

In a statement the NGO Bureau acknowledged that Smug had attempted to register with authorities in 2012, but that the application had been rejected because Smug’s full name was considered “undesirable.”

President Yoweri Museveni, who has been in office since 1986, has made homophobic comments in the past – including in a 2016 CNN interview when he called gay people “disgusting.”

Although there are no laws specifically criminalising being transgender in Uganda, trans people are regularly prosecuted for other offences including “personation” (false representation), according to reports compiled by rights organisations.

Since its establishment almost two decades ago, Smug has campaigned for the rights of LGBT people in Uganda by promoting access to health services and supporting members of the LGBT community to live openly.

It has also taken legal action to protect gay people from hostility, including in 2010 when it successfully petitioned a Ugandan judge to order a newspaper to stop publishing the names and photographs of gay Ugandan men under the headline “hang them”.

The group said several of its members had been attacked or harassed as a result of the article – including one woman who was almost killed when her neighbours began throwing stones at her house.
