It was pretty obvious to me Daniel Penny was not going to be convicted of “manslaughter.”

Woke has cooled down a lot. Presumably, that’s because some kind of super-advanced computer models determined that whatever is left of civil society would collapse if it was pushed any further, and people would start lynching Jews.

If Derek Chauvin was on trial this week, he might have gotten off, and it’s likely that case will be appealed successfully.

Penny is young and handsome, a former marine, he fits into the supposed American ethos of the lone hero taking matters into his own hands. But what he did was much closer to a crime than what Chauvin did (not that what Penny did was illegal, but charging him with manslaughter was less obscene than charging a cop with murder and saying he should have just let the criminal go).

The judge in Daniel Penny’s subway chokehold death trial agreed on Friday to dismiss the manslaughter charge against him, leaving jurors only to consider the lesser count of criminally negligent homicide.

Judge Maxwell Wiley’s decision stemmed from prosecutors’ request to dismiss Penny’s second-degree manslaughter charge after jurors deadlocked twice on that count. Jurors were not able to consider the criminally negligent homicide count until reaching a verdict on second-degree manslaughter.

By agreeing to dismiss this top charge, jurors will be able to continue deliberating the case. Wiley has instructed them to return to court on Monday, according to CNN.

“Judge Wiley is letting the DA withdraw the manslaughter charge. He’ll let the jury consider just criminally negligent homicide now. That’s big for precedent. That also means Penny is now off the hook for manslaughter, though,” Courthouse News reporter Erik Uebelacker said on X.

Penny had been tried on second-degree manslaughter and criminally negligent homicide in the death of Jordan Neely, whom Penny held in a chokehold for about six minutes on a New York City subway car in 2023.

Criminally negligent homicide involves engaging in serious “blameworthy conduct” while not perceiving such a risk. Manslaughter, meanwhile, requires proving that a defendant recklessly caused another person’s death.

Penny’s lawyers say he was protecting himself and other subway riders from a volatile, mentally ill man who was making alarming remarks and gestures. Prosecutors say Penny reacted far too forcefully to someone he perceived as a peril, not a person.

Letting a jury refuse to agree on one charge and then the DA being allowed to keep the other is not usually how these things work. It’s probably a new precedent, as generally this would be a mistrial.

The judge is trying to let the jury convict him on the negligent homicide.

Of course, the maximum penalty for that is four years, whereas he was facing 15 on the manslaughter charge. Chauvin got 20 years.

The prosecutor in the case is literally an Israeli lesbian literally named “Dafna Yoran.” As you’d expect, and is only proper, she looks like a caricature from Der Sturmer.

I saw a thread about it on Twitter, and was shocked no one was mentioning that she’s Jewish, instead referring to her as “a white woman.”

Greg Price is horrible, but then I scrolled the comments and didn’t find anyone saying “Jew.”

If you scroll down, you find some people hinting about “early life check” and so on.

Apart from banning popular people who talk about the Jews (such as your humble host), Elon Musk de-ranks anti-Jewish comments.

Part of this is the clever “pay to win” system he implemented, where your comments only show if you’ve given your real name to Elon Musk. Obviously, most people talking about Jews online do not want Twitter having their real name on file.

A pack of teenage girls randomly attacked an elderly man on a Brooklyn subway platform early Monday — with at least one assailant whacking the victim with a scooter, cops and police sources said.

The 76-year-old man was lying on a bench at the Rockaway Avenue subway station when the five suspects launched the assault, punching and kicking his head around 2:10 a.m., according to authorities.

One of the perpetrators even swung her scooter at the man’s head in what sources said was an unprovoked attack on the northbound C line platform.

Mayor Eric Adams’ controversial plan to install gun-detecting tech in the Big Apple’s beleaguered transit system was booted up Friday in lower Manhattan.

The weapons scanner pilot program from company Evolv, which was unveiled by the tech-loving mayor in March, went live in the Fulton Street station at around 4 p.m., ahead of the evening commute.

A Post reporter observed passengers forking over their handbags and backpacks to police for inspection before they passed through the electronic detector, where there was a sea of additional officers waiting on the other side. Once cleared, they walked back and retrieved their items.

One police officer wearing rubber gloves was seen thoroughly searching one straphanger’s black backpack, carefully going through each pocket.

Commuters who spoke to The Post welcomed the scanners — as long as they are accurate and don’t hold up the hurried commuters.

When the program is implemented only random people — every five people or so — will be selected to go through the detector, Adams told reporters at a press conference Friday evening.

He described the new weapons technology surveillance pilot, which uses electromagnetic technology, as “groundbreaking” — noting scanners will be placed at “select” stations throughout the city “over the next month.”

This hardly seems like a long-term solution to the problem of escalating violence.

It seems to me that this is a social problem, and not a problem of access to guns.

A commuter was struck and killed by a Manhattan subway train Monday after being shoved onto the tracks by an emotionally disturbed person in an unprovoked attack, according to police and sources.

The victim was pushed onto the tracks as a northbound 4 train was entering the East 125th Street and Lexington Avenue station in East Harlem just before 7 p.m., police sources said.

The train was unable to stop in time and fatally struck the individual, an adult male whose identity has not been released.

The man was pronounced dead shortly after and a suspect, described as an emotionally disturbed person, was taken into custody, according to the sources. Charges are pending.

Earlier in the day, Kemper and other NYPD brass announced the department would deploy 800 more cops into subway stations over the next five days to hunt down fare-beaters, claiming the move curbs more violent crimes.

The government/media narrative right now is that this is all very normal, that the subway is basically as safe as it ever was, and people just need to stop complaining and accept that there is always some risk that a stranger will kill you randomly.

People who claim there is too much crime on the subway are de facto antisemites.

After all, America only has so much money. We can’t be fixing the subway when Israel is in need.

Crime on the subways has become significantly more violent since the pandemic with the number of felony assaults soaring when compared to pre-pandemic levels, an analysis by The Post revealed.

The number of attacks on trains that left victims injured jumped 53% from 2023’s 570 felony assaults to the 373 reported in 2019, according to stats.

Those 200 extra felony assaults meant that attacks resulting in substantial injury accounted for 25% of 2,285 major crimes reported on trains and in stations in 2023, compared to just 15% of the 2,499 major crimes in 2019, the data show.

Ridership remains down about 30% compared to the pre-pandemic years. These days approximately 4 million people ride the subways a day during the week, compared to 5.5 million in the run-up to COVID’s arrival and the city’s shutdown, according to estimates.

The surge in attacks underground that left victims injured and in need of treatment comes as the transit system sees a surge in murders.

There were three murders underground in 2019 compared to 10 in 2022 and five in 2023, according to the analysis.

There have already been three murders in the first three months of 2024, the data show.

Without the surge in assaults, overall crime in the transit system would be roughly in line with the rates seen underground before the pandemic when adjusting for ridership.

The surge in violence has left cops and criminal justice experts flummoxed, with no clear explanation of what is driving the disturbing trend.

I think it might have been a mistake to tell blacks they wouldn’t be arrested for violent crime. From what we’ve seen, this makes them more likely to commit violent crime.

The former U.S. Marine sergeant accused of fatally strangling Jordan Neely, a homeless man, in a chokehold in a New York subway car last month pleaded not guilty to charges of manslaughter and criminally negligent homicide in a court appearance on Wednesday.

Daniel Penny, 24, was captured in videos recorded by bystanders putting Neely in a chokehold from behind for several minutes on May 1 while they rode on an F train in Manhattan. The killing drew national attention and sparked protests in May by those angered by the police’s delay of more than a week in arresting Penny, who is white, with killing Neely, a Black man.

Penny first appeared in the Manhattan Criminal Court on May 12 on a charge of second-degree manslaughter, a felony crime that carries a maximum sentence of 15 years in prison. Judge Kevin McGrath released Penny on a $100,000 bond and ordered him to surrender his passport.

After that hearing, a grand jury voted to indict Penny on June 14.

In the minutes before he was killed, Neely, a 30-year-old former Michael Jackson impersonator who struggled with mental illness, had been shouting about how hungry he was and that he was willing to return to jail or die, according to passengers on the subway car.

Penny has said he acted to defend himself and other passengers, and did not intend to kill Neely, and he has been hailed as a hero by prominent Republican politicians. Protesters have decried Penny as a vigilante and described Neely’s death as a lynching.

This is exactly what Andrew Anglin said in 2020 was coming down the pipe: white people are being charged with crimes for defending themselves against violent blacks.

He said that would happen, and here we are.

It goes without saying that getting into a fight with a pregnant woman is wrong in almost every thinkable scenario, but in this case it was totally justified.

Blacks attacking Asians is very common in the NYC subway system. The clash is caused by Chinese immigrants being used to shoving or bumping into people on the train, as is custom in their home country, which intersects with the Negro hair-trigger for savagery. A lot of the people who are thrown in front of moving trains in the city are Asians pushed on the tracks by blacks, usually over a bump.

This is the kind of incoherence you get when you have multi-culturalism.

Police say Lee kicked Rodney twice in the stomach Thursday as the two tangled on an uptown No. 4 train.

Prosecutors had pushed for $20,000 bail, arguing Lee was the one who got physical.

“This was a violent attack on a . . . pregnant woman on a crowded rush hour subway train,” Assistant District Attorney Joseph Abrams told Hanshaft.

But Lee’s attorney argued that he was just trying to hold off Rodney, who attacked him first.

When Rodney and Lee bumped into each other the packed car, it was the pregnant 28-year-old who reacted with so much aggression Lee got knocked to the floor, Fletcher said.

I think this is where she snapped, she ends up holding on to his collar, his back is still facing her, so once she has her hands on his collar, this is where she turns around and she ends, her hands end up on his head.”

Janice said things then spiraled. With Lee now facing the woman, backing up trying to get away from her, she held on to him, causing him to fall. She ended up holding onto him, on top of him.

“So when she’s hunched over him, this is when he kicks her,” Janice said. “And the kick, since she’s over him diagonally, the kick lands on her stomach, right on the bottom of her belly.”

So normally, a man knows not to kick a pregnant woman. Normally, a woman knows not to lunge at a stranger on the train over a slight bump, and then tackle him to the ground like a linebacker and start pounding him. But in this case, a likely obese Negress (it can be hard to tell when they’re pregnant) started assaulting a frail Asian man who was trying to get away, and the Jew assistant DA Joseph Abrams wants to send him to Sing Sing over a kick that didn’t injure her or her baby.

The state’s agenda is to facilitate Negro violence, not control it. The idea is to keep society in every day tension and create a climate of fear. When Negroes get out of control and you fight back, they know to play the victim, because there will always be an (((Abrams))) providing them air cover.
