Monday’s ruling has blocked the Italian government’s efforts for the second time to implement its plan to outsource the reception and repatriation of migrants, as part of an agreement signed with Tirana last year.

The seven asylum seekers are from Egypt and Bangladesh, the two countries at the center of an ongoing dispute between the judiciary and the government.

The conflict began when the government appealed a similar decision from last month to the Court of Cassation, which is expected to rule on the case in December.

They ruled that Bangladesh and Egypt do not meet these criteria, based on a recent ECJ ruling that a country must be safe in all its regions and for all of its citizens to be deemed “safe.”

Luciana Sangiovanni, the president of the Chamber of the Court, explained that while respecting national lawmakers’ powers, judges are obligated to ensure the correct application of EU law, which takes precedence over national laws that conflict with it.

She also noted that the exclusion of a country from the “safe” list does not prevent the repatriation of migrants whose asylum claims were overturned, but rejected the idea of automatic repatriation to certain countries, as proposed by the government.

The month of July saw more illegal immigrants arrive in Italian territory than the entire year of 2019, as landing continue in areas like the overwhelmed island of Lampedusa.

In 2019, just 11,471 migrants arrived in Italy during the entire year but statistics from the United Nations High Commissioner for Refugees (UNHCR) have revealed that in the month of July alone a total of 13,197 migrants landed, the highest monthly arrival rate since June of 2017.

Salvini served as Interior Minister of Italy for much of 2019 until his party’s coalition with the Five star Movement (M5S) collapsed and he resigned from his post in September.

During his time as Interior Minister, however, Salvini was credited for greatly reducing illegal arrivals as well as subsequent drowning deaths in the Mediterranean, which numbered 754 in 2019 and have risen every year since according to the UNHCR.

On Monday, the migrant taxi ship Ocean Viking dropped off nearly 400 migrants in the port of Salerno, while the ship Sea Watch 3 was able to disembark a further 438 migrants in Taranto over the weekend. Another ship, the Geo Barents, was waiting to drop off 659 migrants as of Monday.

They’re all going to end up in the UK and Germany anyway.

A row ensued Wednesday after the public safety and security councillor in the northern city of Voghera, Massimo Adriatici, was arrested on suspicion of shooting and killing an illegal Moroccan immigrant after an argument outside a bar on Tuesday night.

Adriatici, a lawyer and member of the rightwing League party, allegedly fired at the 39-year-old immigrant in self-defence, the League said.

Adriatici said the fatal shot went off accidentally after he was pushed to the ground by the victim.

But police said he shot and hit the immigrant near the heart after he was pushed by him, according to judicial sources.

Police ruled out the veracity of a report from several bar clients that a man saw the immigrant throw a bottle at the official.

The immigrant may, however, have thrown a bottle previously while he was bothering, as he often did, people outside the bar in Piazza Meardi, police said.

The immigrant was unarmed during the confrontation with Adriatici, police said.

The League previously had said he was defending a girl from alleged molestation by the immigrant, who they said had a history of being drunk and disorderly as well as violent.

League leader Matteo Salvini said “far from being the Wild West in Voghera, the hypothesis of legitimate self-defence is becoming clearer.” The former interior minister and deputy premier said “we’ll wait for the reconstruction of events, there are no citizens that go around shooting people with their legitimately held weapons, but self-defence is obviously always legitimate in the case of being attacked, as a last resort”.

Adriatici is a prominent lawyer in the town near Pavia in Lombardy and has started initiatives against riotous and drink and drug fuelled street night life known as the ‘malamovida’.

An anti-alcohol ordinance he promoted came into force Tuesday night, local sources said.

Reportedly a former policeman, he also teaches criminal law to police cadets at Alessandria.

He has suspended himself from his post, Voghera Mayor Paola Garlaschelli said.

The victim, Youns El Boussetaoui, had a long criminal record for threats, resisting arrest, drug pushing, escaping detention, drunk driving without a license, fraud and illegal weapons possession, judicial sources said.

The Democratic Party (PD) said “what happened in Voghera is a huge event, which must spur everyone, and first of all the League, to reflect” on alleged vigilante justice.

The bar owner, Robino Punturiero, said “I don’t justify in any way what happened but this person (El Boussetaoui) is absolutely not a victim, we have been the victims for some time”.

He said “I have known Massimo Adriatici for a very long time, he is a great bloke, calm, I can’t say anything (against him), he has always helped us and he used to get the Carabinieri to patrol around here”.

Matteo Salvini, the head of Italy’s right-wing League party, should not stand trial over allegations he kidnapped a group of migrants by refusing to let them disembark from a ship, a judge in the Sicilian city of Catania ruled on Friday.

The case centred on an incident in July 2019, when Salvini, then interior minister, blocked more than 100 people aboard the Gregoretti coastguard ship for six days as he waited for European allies to agree to resettle them.

The Catania case is similar to a separate investigation in the Sicilian capital of Palermo over migrants who were kept aboard another boat a month after the Gregoretti incident.

However, in a completely contrasting decision, a judge in Palermo last month ordered that Salvini should stand trial over the allegations. He could face up to 15 years in prison if found guilty. 

“If there was no kidnapping in Catania, then I do not see why there should be kidnapping in Palermo,” Salvini told reporters after Friday’s ruling.

Salvini and his allies are currently polling over 50% between them, and they’re very likely to win a majority in the next parliament.

Chanting “Freedom!” the angry crowds marched through the city streets on Friday night, with some hurling bottles, smoke bombs and other projectiles at the officers. Others attempted to erect barricades using garbage containers and set some of them on fire. Police deployed tear gas as they tried to disperse the rioters.

The public was further outraged when Governor Vincenzo De Luca announced on Friday that an “immediate” lockdown for up to 40 days was essential to stop the spread of the coronavirus. “The current data on the infection rate suggests that any type of partial measures is ineffective,” he said, explaining that it was vital to close down “everything,” except for businesses providing essential services, and to block movement between the regions.

A leaked chat between Italian magistrates revealed that while they admitted thinking in private that former interior minister Matteo Salvini’s migrant policies were correct and legal, they chose to attack him publicly anyway.

The leaked messages were made on WhatsApp in 2018 while Salvini served as interior minister. During that time, judges were continually attacking the League leader for his policy that closed Italy’s ports to migrant transport NGO vessels operating in the Mediterranean.

Paolo Auriemma, chief prosecutor of the city of Viterbo, stated in one message revealed by newspaper La Verità: “I’m sorry to say that I don’t really see where Salvini is wrong. Illegitimate attempts are made to enter Italy, and the Minister of the Interior intervenes to prevent this from happening. And I don’t understand what the Agrigento Prosecutor has to do with it.”

According to an Il Giornale report on Thursday, the message was met with a response from magistrate Luca Palamara, who said: “You are right. But now we must attack.”

I haven’t read a word about this in any publication even close to the mainstream today, and I’ve gone through quite a few of those.

None of the people who screech about “authoritarianism” and “rule of law” seem to be concerned with these scum prosecuting someone they don’t think broke any laws.

Last year, Palamara was investigated on corruption charges after allegedly taking €40,000 (£36,000/$44,000) from lawyers who were at the centre of another corruption investigation.

During the WhatsApp chat, Auriemma went on to question attacking Salvini’s migrant policies, saying that “everyone thinks like him” and that his move to stop mass migration was popular with the general public.

The chats are just a small sample of the leaked files, according to the newspaper, which added that the content of the messages left members of Salvini’s League speechless.

A group of League MPs petitioned President Sergio Mattarella to investigate the matter, saying: “What was reported by the newspaper is very serious and intolerable: the independence of politics with respect to the judiciary must be preserved.”

Salvini sent a letter to the Italian president on Thursday and published its contents on his Facebook page. He stated that he was concerned about judicial impartiality given he faces a potential trial over allegations of kidnapping migrants during his term as interior minister. The hearing is set for October.

“This affects the principle of separation of powers and gives me real concern about the lack of unbiased judgement that affects the outcome of the procedure against me,” he said.

Well, the good news is he wasn’t really going to jail anyway, and the idiots actually gave his poll numbers a boost, so him and his buddies will probably get a comfortable majority in the next parliament.

After weeks of negotiations marked by political infighting and resignation threats, the parties in Italy’s coalition government finally reached an agreement on Wednesday to approve provisional changes to permits for farm workers and home carers.

Dino Martirano, a spokesman for Italy’s interior ministry, told Al Jazeera foreign labourers in the agricultural and domestic working sectors who have been without a valid residency permit since November will be able to apply.

According to the decree unveiled on Wednesday, the new residency permits will be valid for six months.

The changes also seek to legalise irregular work in farms and homes. Martinaro said employers who have irregularly hired either foreign or Italian workers in these sectors would also able to apply to regulate their staff by stipulating a fixed-term employment contract.

“We have reached an important result,” Prime Minister Giuseppe Conte said in a news conference after a cabinet meeting.

As a result, Italy is now at risk of losing 25 percent of its harvest, according to Italian leading Agriculture association Coldiretti.

“We got it,” Jean-Rene Bilongo, head of migration policy and inequalities at the CGIL-FLAI farmworkers’ trade union, said after the amnesty was unveiled.

“Thousands of migrants living at the margins of society will now become legal subjects – the invisibles become citizens,” he told Al Jazeera.

They don’t need more workers, they just want cheaper workers.

And the government shouldn’t be giving them any, that’s not your job, you’re supposed to run a country not a supermarket.

Yet, human rights groups decried the temporary nature of the amnesty.

“A time-limited amnesty is just a patch, an absurdity which gives priority to production over dignity,” said Cesare Fermi, director of migration programmes for INTERSOS, an NGO.

Calling the measure “a lost chance”, Fermi added: “How will the workers’ conditions change once the permit is over?”

In recent weeks, the issue of regularisation had threatened to tear apart the ruling coalition led by the anti-establishment Five Star Movement and the centre-left Democratic Party (PD).

The Senate’s immunity panel had already given the OK for the Catania court of ministers’ request to parliament to proceed against Salvini for allegedly abusing his power and the floor of the Upper House has now ratified the decision to lift Salvini’s parliamentary immunity.

Salvini, who operated a closed ports policy while interior minister in the last government, sending the League’s poll ratings sky-high, faced prosecution before but his parliamentary immunity was never lifted so he could go to trial in previous similar cases.

“I’m absolutely relaxed about this and proud of what I did,” Salvini told ANSA after the vote, which members of his party did not take part in.

“I’ll do it again as soon as I get back in government.

“I swore on the Constitution, which says that defending the nation is every citizen’s duty.

“I defended Italy”. Salvini argued that, as in other such cases, his decision was made with the rest of the government he was then part of.

This is gonna help them win the next elections with an even better score, hence why Salvini himself told his party to vote for it.

And the case itself is gonna be thrown out at some point, too.
