A wise man once observed that America is a fag nation. Among other things, this was proven out by the fact that, like a bunch of fags, America banned machine guns. Only a fag nation would ban machine guns.

A federal judge on Friday ruled that a ban on possessing a machine gun is unconstitutional as he dismissed charges against Tamori Morgan, who had been charged with two counts of illegally owning a machine gun, the Daily Caller reported.

Trump-appointed Judge John Broomes, of the US District Court for the District of Kansas, wrote, “The court finds that the Second Amendment applies to the weapons charged because they are ‘bearable arms’ within the original meaning of the amendment. The court further finds that the government has failed to establish that this nation’s history of gun regulation justifies the application of 18 U.S.C. § 922(o) to Defendant. The court therefore grants the motion to dismiss.” Prosecutors had charged Morgan with violations of 18 United States Code § 922(o) – which says, “it shall be unlawful for any person to transfer or possess a machine gun.”

Prosecutors charged Morgan because he had an Anderson Manufacturing, model AM-15 .300 caliber machine gun in his possession as well as a “Glock switch,” a device that converts the Glock to an automatic weapon, court documents state.

The Anderson is just a normal AR platform. (The .300 is a bit more hardcore than the normal 5.56×45mm NATO.)

The Glock Switch is something separate. It’s a little piece of metal that will turn a Glock handgun into a fully automatic.

The court is legalizing both machine rifles and pistols at the same time.

At least, that is the implication, if this is not appealed and overruled.

Broomes said the impetus was on the government to prove there was a historical basis for banning machine guns.

Congress has tried to control the ownership of machine guns with the National Firearms Act of 1934 and with the outright ban in 1986. Prosecutors in the Morgan case had insisted that his machine gun was not covered by Second Amendment rights.

Broomes upended that assumption by saying machine guns are protected “within the original meaning of the amendment.” The Department of Justice (DOJ) can choose to appeal the ruling. “Plaintiff is charged with two counts of machinegun possession, and both counts apply to arms that can be carried in the hand. Thus, by definition, the machinegun and Glock switch are bearable arms within the plain text of the Second Amendment,” Broomes wrote.

Assuming everything goes through, this is the biggest win for gun rights in most of our lifetimes.

As Andrew Anglin oft notes, if the people are not allowed to own and carry concealed machine pistols, the First Amendment is null and void, given that these are clearly “bearable arms.”

This will open a new industry on manufacturing automatic weapons and well as allowing the Glock Switch and other mods to be widely sold and implemented.

The ATF has been obsessed with Glock Switches since the 1980s. Now, assuming all goes well, you’re just going to be able to order them online.

The sale of firearms on the internet and at gun shows in the US will in future be subject to mandatory background checks, the justice department said on Thursday as it announced a “historic” new action to keep weapons out of the hands of criminals.

The closing of the so-called gun show loophole, which exempts private transactions from restrictions that apply to licensed dealers, has long been a goal of the Biden administration, and is specifically targeted in the rule published in the federal register today.

“Under this regulation, it will not matter if guns are sold on the internet, at a gun show, or at a brick-and-mortar store: if you sell guns predominantly to earn a profit, you must be licensed, and you must conduct background checks,” attorney general Merrick Garland told reporters on a press call announcing the measure.

“This regulation is a historic step in the justice department’s fight against gun violence. It will save lives.”

The rule, which clarifies who is considered to be “engaged in the business” as a firearms dealer, will take effect in 30 days’ time, and follows a three-month consultation period that attracted almost 388,000 comments to the website of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The White House estimates that 22% of guns owned by Americans were acquired without a background check and that about 23,000 more individuals will be required to be licensed as a dealer after the rule’s implementation.

“There is a large and growing black market of guns being sold by people in the business of dealing and doing it without a license, and therefore they are not running background checks the way the law requires,” ATF director Steven Dettelbach said.

“It’s not safe for innocent, law-abiding Americans. In fact, it’s doggone dangerous.”

Remember: anyone who talks about the Constitution as if it is somehow active is full of shit.

Every conservative who goes on and on about the Constitution is a liar and a fraud.

The Constitution has not been active since like, the Civil War.

They have banned all kinds of guns that the Constitution obviously protects. They have passed totally illegal gun control laws in cities. No city is allowed to pass a gun control law. And the government was never allowed to ban full-automatic weapons.

According to the Constitution, you can carry a concealed machine pistol – without any license to do so – on all public property in America. It’s been a very long time since the fed government allowed you to do that.

It’s the same thing with freedom of speech. If you look at what was done to Alex Jones – or to others who have been sued in civil court over what is obviously protected speech (it’s happened to several others) – then you have to admit that the First Amendment is no longer active, at all.

Pretending the Constitution is active simply plays into the hands of the enemy.

There is no Constitution. All that talking about the Constitution does is allow the enemy to claim they represent the Constitution. Actual defenders of America might call for the Constitution to be reinstated, but pretending like “it’s against the Constitution” is somehow a defense of anything is simply absurd.

Homicides in the Bluff City have reached over 352 as of Monday, according to numbers from the Memphis Police Department, breaking the previous record set in 2021.

Shootings and killings are leaving community leaders frustrated. They say it’s time to get to the real issues that drive violent crime in Memphis.

Families of homicide victims are also fed up and still searching for answers about why these pointless shootings keep happening in the Bluff City.

“State senators like Brent Taylor think they can say, ‘Add a few more Tennessee state troopers.’ Well, Tennessee state patrol has conducted over 17,000 traffic stops since January and only made 12 felony arrests,” said Pastor Earl Fisher of Abyssinian Missionary Baptist Church.

MPD says that so far this year, there have been 298 murders and 352 homicides, which include the two victims of Monday’s deadly shootings in North Memphis.

“[This is a] 42% increase in homicides from this time last year,” said Fisher. “That only tells part of the story. It doesn’t tell the story of gun laws that have been passed in Nashville by some of the people that govern places like Shelby County that are saying we are in a warzone. You helped manufacture the warzone.”

In 2021, there were 303 murders and 346 homicides.

Fisher said gun laws need to be changed in order to bring real change.

“Open carry in the state, it’s easier, especially for Black communities and Black children, to get access to guns and drugs than it is for them to get access to jobs that pay a livable wage or equitable educations,” said Fisher.

Yeah but. Anyone can get access to guns and drugs? Maybe they shouldn’t though?

There are several reasons why people believe crime is up in Memphis.

Some cite mental health issues, while others say the poverty rate in Memphis is driving people to a survival mentally.

Hm.

It could also be that they’re doing this because they’re black, no?

We should probably at least consider that possibility.

The chief of police is a black woman

You have to allow black people to commit crimes.

That’s the law.

You can’t simply go around harassing innocent blacks who are simply trying to mug people.

New York police have arrested a man who they say opened fire on a subway platform Tuesday night that scared off a would-be mugger who himself is facing attempted robbery charges.

No one was hurt in the altercation, which erupted after a 49-year-old homeless man allegedly tried to mug an unidentified 40-year-old woman near the exit.

The NYPD arrested John Rote, 43, of Queens, on Wednesday afternoon, hours after asking for the public’s help tracking him down in connection with an altercation on the 49th Street NRW station platform the evening before.

Rote overheard Matthew Roesch, the mugging suspect, demanding the woman give him money, or he’d steal her purse, according to authorities.

Rote is accused of firing shots, interrupting the attempted robbery without striking anyone. Surveillance images show him calmly walking out through the turnstile, carrying a tote bag from a popular camera store, a green bookbag and a tablet.

Now he faces charges of criminal possession of a weapon, reckless endangerment, criminal possession of a firearm and menacing.

Rote could not immediately be reached for comment.

“I want to be clear: we don’t tolerate this kind of conduct in NYC Transit, period,” the city’s top transit official, Richard Davey, said in a statement after Rote’s arrest. “Once again cameras recorded a perpetrator, and we are grateful the NYPD made an arrest within hours. Thank goodness nobody was hurt here – but what occurred was outrageous, reckless, and unacceptable.”

Good thing the mugger wasn’t black, or else this Rote guy would be looking at life in prison right now

Transit crime in the city has declined by 3.6% so far this year after surging during the coronavirus pandemic and anti-police protests over the death of George Floyd in Minneapolis. They are 29% higher than they were in 2021 year-to-date, police statistics show.

Some of the attacks have been particularly brutal, with dozens of incidents of travelers being shoved from behind in front of moving subway cars.

What has this country come to, that a black mother has to worry that her son is going to have a warning shot fired near him for no other reason than that he was mugging people on a subway?

Police arrested a D.C. city employee Tuesday over the fatal shooting of a 13-year old that has roiled community passions.

Jason Lewis, a longtime Parks and Recreation Department employee, turned himself in Tuesday morning to face charges of second-degree murder while armed. Lewis shot Karon Blake on Jan. 7, around 4 a.m., across the street from the middle school Blake attended.

The shooting prompted a fierce community response, with Metropolitan Police Department chief Robert Contee facing intense public pressure to either arrest the shooter or reveal their identity. Lewis. 41, was ordered held without bond until a Feb. 13 court appearance.

The picture is difficult to find. No mainstream media outlet bothered to include any picture of him in their reports, presumably to make people assume it’s a white guy.

“The investigation took the amount of time that it needed to take,” Contee said Tuesday. “There was somewhat of a self-defense claim that needed to be overcome.”

The charges don’t hinge directly on the shots that killed Blake, but rather to an earlier gunshot that Lewis didn’t mention in his initial statement to police. The arrest warrant acknowledges that Blake was part of a group of youths apparently robbing parked cars, and that Blake apparently ran straight at Lewis before he opened fire from his property.

But it charges Lewis with setting off the violent chain of events with an earlier shot that he fired — one which Contee said ”was not part of the initial discussion that we had,” when Lewis made his original statement to police.

Contee said multiple residents on the block came forward with video evidence from their own security cameras. The arrest warrant delves into a chilling level of detail from that footage, including Blake pleading after he was shot.

“The decedent (Blake) can then be heard yelling, ‘I am sorry’ numerous times, followed by ‘Please don’t’ and ‘No’ numerous times. The decedent yells, ‘I am a kid’ and ‘I am only 12’ numerous times,” it states.

That footage, which hasn’t been publicly released, showed Blake and his companions emerging from what turned out to be a stolen car and breaking into parked cars in Lewis’ Brookland neighborhood, the warrant claims. “They had flashlights, they were peering into cars and they were going into the cars,” Contee said.

Lewis is charged with firing first at the young man who remained seated in the stolen car. In the confusion after that first shot, Blake apparently ran directly at Lewis and was fatally wounded.

“The first shot was fired … at someone sitting in a vehicle who wasn’t an immediate threat,” Contee said Tuesday. This original shot, when Lewis had no claim of being personally under threat, was “where things really unraveled” and “put the chain of events into place” that resulted in Blake’s death, Contee said.

A statement from Lewis’ attorney, Lee Smith, maintained his innocence and said, “While this is certainly a tragedy, once all the facts are heard, I believe that a jury will find that there was no crime here.”

These sorts of things happen all year around. It’s just that when BLM riot season comes, they start reporting on them, and presumably making arrests they otherwise wouldn’t have made.

George Zimmerman wasn’t arrested on the scene. The cops realized immediately it was self-defense. Then ABC edited his 911 call and Obama came out and claimed Trayvon was his son. So Zimmerman got arrested and put on a monkey trial.

It’s the same thing with this guy Lewis. He presumably won’t be convicted. This is just a huge spectacle by the media to encourage rioting.

I don’t get what they’re celebrating. He’s dead, no? Are they celebrating that he’s dead? Are they also racists? 

If a state were to actually put restrictions on mutilating children, the federal government would come in and override them.

The federal government is already forcing schools to turn all the children into trannies. They’re not going to back down from any of this stuff.

An Oklahoma lawmaker introduced two bills in one week that would lower the age to purchase and carry guns and increase the required age for people to receive transgender health treatments.

“You have, in the Constitution, specifically enumerated, your right to keep and bear arms,” Republican state Rep. Jim Olsen told KTUL. “If you were to ask the Founding Fathers, ‘Where is it in the Constitution that you can get gender reassignment surgery?’ I think they’d have had a very puzzled look on their faces.”

A self-described constitutionalist, Olsen proposed lowering the age to purchase firearms in the state to 18, while increasing the age for transgender healthcare to 21.

People living in Oklahoma must be at least 21 years old to qualify for the state’s permitless carry law, unless the individual is currently serving in the armed forces or a military veteran. House Bill 1001 would allow Oklahoma residents as young as 18 years of age to purchase, to concealed carry and to open-carry firearms.

“We need to realize that the great majority of mass shootings occur in a gun-free zone,” Olsen said. “If you took away the gun-free zones, you occasionally would have somebody that wants to do something like that, but they would be quickly neutralized by somebody that’s legally carrying their weapon.”

He added that 18-year-olds can serve in the military, and “carry weapons, and it usually turns out just fine.”

Other experts, including the Crime Prevention Research Center’s John Lott, have argued that the U.S. could do away with gun-free zones to decrease mass shooting incidents.

“These gun-free zones actually serve as magnets for these killers to attack. Because they know they’re going to be more successful in terms of killing,” Lott previously told Fox News Digital.

As for his transgender bill introduced last week, Olsen said its purpose is “to protect our children from genital mutilation.”

“A lot of the people in the schools are telling me that it’s kind of the cool thing these days to be transgender,” he said.

“We have vulnerable young people who are being told by people that are either wicked, or confused, or a mixture of both, that this will fulfill them and make them happy,” he continued. “And it won’t. And it’s causing a lot of harm.”

The bill, House Bill 1011, would ban gender transition services, including puberty blockers, reassignment surgeries and hormone therapy, to people under the age of 21.

“There are some things that are so harmful that they need to be outlawed,” Olsen told KTUL. “We need to prevent surgeons from harming people.”

Olsen offered a contrast between his two bills, arguing that carrying a firearm at 18 is easy to undo if a person decides they are no longer comfortable with decision, while reversing gender transition services is nearly “impossible.”

“Let’s say we decided we wanted to carry a weapon when we’re 18,” Olsen told Fox News Digital. “And then we do it and we decide, ‘You know I’m just not comfortable with this.’ You can stop carrying the weapon. It’s no big deal … But to undo the effects of the other is – usually it’s impossible. Sometimes you can kind of partly get back, but it’s hard to undo all of that.”

The American Psychological Association, however, says that denying gender transition health care “puts individuals at a significant risk of harm,” and among young people, they are “more than twice as likely to report having attempted suicide.”

The fact that there is so little resistance to this tranny child agenda just proves that this country is too far gone.

Attorney General Eric Holder waded deeper into the controversy over the George Zimmerman case and verdict on Tuesday, suggesting a national review of “stand-your-ground” laws during a speech before the annual NAACP convention in Orlando.

The NAACP is at the forefront of the effort to pressure the Justice Department to bring federal civil rights charges against Zimmerman. Holder confirmed on Monday that his department is reviewing that possibility, citing his personal concerns about the case.

He went a step further on Tuesday, weighing in for the first time on controversial state-level laws on self-defense.

“Separate and apart from the case that has drawn the nation’s attention, it’s time to question laws that senselessly expand the concept of self-defense and sow dangerous conflict in our neighborhoods,” Holder said.

The comments were a reference to so-called “stand-your-ground” laws, which in Florida and other states allow people to use deadly force if they think their life is being threatened.

The role that law played in the Zimmerman shooting of 17-year-old Trayvon Martin is a matter of dispute.

But Holder suggested the laws encourage confrontation, saying there “has always been” a legal defense for using deadly force when retreat is not an option.

“But we must examine laws that take this further by eliminating the common sense and age-old requirement that people who feel threatened have a duty to retreat, outside their home, if they can do so safely,” Holder said. “By allowing — and perhaps encouraging — violent situations to escalate in public, such laws undermine public safety.”

He called for a “hard look” at the laws. The crowd applauded as he said “we must stand our ground.”

The “stand-your-ground” laws have been a popular target ever since the Martin shooting, and the pressure has intensified after Zimmerman was acquitted on Saturday.
