Nearly a week after a crash that killed one person from Texas and injured another, felony charges have been brought against the Fort Yates woman accused of causing the crash.

Court records show a warrant has been issued for the arrest of 28-year-old Terri Kay Yellowhammer. She’s accused of criminal vehicular homicide, which is a class A felony, as well as three lesser charges.

According to a police affidavit and a report from the North Dakota Highway Patrol, Yellowhammer was involved in a crash on Highway 1806 south of Mandan on May 6.

Authorities say she missed a curve in the road and began entering the ditch, then over-corrected and veered into the oncoming lane. Her vehicle collided with a truck carrying two people from Texas, Conan and Angela Magilke.

Both vehicles came to rest upside-down in a ditch. Authorities say Conan Magilke was pronounced dead at the scene. Angela Magilke and Yellowhammer were taken to a hospital in Bismarck with injuries.

Authorities say Yellowhammer admitted to having smoked methamphetamine the night before the crash. The affidavit says she told police she felt like she was driving through icy, windy conditions — but the responding officer said it was not windy, and the temperature at the time of the crash was above 60 degrees.

It was also determined that she had been driving with a suspended license.

Officials say Yellowhammer was arrested for driving under the influence after last week’s crash. On Tuesday, authorities brought additional charges against her: class A felony criminal vehicular homicide, class C felony criminal vehicular injury, class C felony reckless endangerment and class B misdemeanor driving with a suspended license. The most serious offense carries a maximum penalty of 20 years in prison.

Court records also indicate additional open cases against Yellowhammer related to drug possession. A preliminary hearing and/or arraignment is scheduled for those charges on June 22.

A Louisville man has been charged with murder after police said he drove drunk, causing a crash that killed one man and seriously injured four other people, including three children.

The crash took place around 11 p.m. Tuesday on Millers Lane, just west of Dixie Highway, according to court documents. Police said Jermaine Sneed, 36, was intoxicated while driving eastbound at a high rate of speed and crashed into a van driven by Danny Whitfill, according to an arrest warrant.

Whitfill died at the scene, according to police, who said both cars were engulfed in flames by the time officers arrived.

“It was a horrific scene,” said Lt. Col. Josh Myers, assistant chief of police for the Shively Police Department. “There were neighbors who had pulled some of the injured folks from the cars.

“The flames were high enough to where they were actually reaching the transformer on a telephone pole,” he added.

A woman and two children in the van with Whitfill were badly injured in the crash. The woman was taken to University Hospital in critical condition. The two children were taken to Norton Children’s Hospital. One of them suffered a broken leg. The second child was in critical condition. Their current conditions are not known.

These bean folk sure seem to have a problem with drink driving.

The obvious solution is to import tens of millions more of them into the country and hope it all works out somehow.

A man has been arrested in connection to a fatal New Year’s Eve DUI crash with an airport shuttle van.

Phoenix police arrested 49-year-old David Garcia Arteaga on Thursday at his home near 16th Street and Thomas Road.

On the night of December 31, 2019, Phoenix officers responded to the intersection of 32nd and Washington streets to investigate reports of a two-car collision, according to Phoenix police spokeswoman Mercedes Fortune.

Police say the airport shuttle was traveling northbound on 32nd Street when it was struck by Arteaga’s truck traveling east on Washington.

Witnesses and surveillance video reportedly showed that Arteaga ran the red light at the intersection.

The truck’s data recorder reportedly showed that the vehicle was going about 60 miles per hour at impact.

The driver of the bus, a 39-year-old man, and one passenger, a 74-year-old man, suffered minor injuries. Another passenger, 75-year-old Kathleen Watson, was pronounced dead at a hospital.

Watson’s family said she was coming back from a 10-day trip to Hawaii when the airport shuttle was hit head-on.

Police say Arteaga remained at the scene and was taken to a hospital where he required multiple surgeries. Court records show that his BAC level was .192.

Arteaga was arrested for endangerment, aggravated assault, and second-degree murder.

He was drunk, of course.

A Sioux City man who ran a stop sign and caused a fatal crash last summer has been given 10 years in prison.

Woodbury County court records say Julian Espinoza, 33, was sentenced Monday in Sioux City. He’d pleaded guilty to vehicular homicide by driving recklessly, causing the July 26 crash that fatally injured Ronald Hacker, of Sioux City.

As part of a plea agreement, an initial charge of vehicular driving while intoxicated was changed and a charge of child endangerment resulting in bodily injury was dismissed. Espinoza’s juvenile son was in his pickup truck at the time of the crash.

The crash happened when Espinoza drove his pickup through a stop sign in Sioux City and collided with a vehicle driven by Hacker, police said.

A local college is dealing with the tragic death of a student as 37-year-old Kevin Mroczko was killed early Sunday morning when a drunk driver hit his motorcycle on US-401 near Byrd Road.

Mroczko was a military veteran and a student at Methodist University.

Curtis Harris of Benson is charged in Mroczko’s death. The charge list includes felony death by motor vehicle, two felony counts of hit and run, and four misdemeanors including a DWI.

Troopers say it was dark and foggy early Sunday morning when Harris ran into the back of Mroczko’s Harley Davidson, throwing him and his fiancée Stephanie Warn off the bike. Mroczko died instantly. Warn was flown to UNC where troopers say she is in a coma.

Mroczko’s death sent shockwaves of grief through the nursing school where he just started in August after transitioning out of the military where he deployed several times.

Dr. Shannon Matthews was devastated when she got the news but said the students are taking the loss even harder.

“I mean they were so close. They were in classes all day together so they eat lunch together. They had lab together twice a week. They knew each other very well so this had been devastating,” Matthews said.

A 28-year-old woman is dead and a 26-year-old man in critical condition after a man driving a stolen car collided with their vehicle early Sunday.

Carol Major, 28, of Santa Clara and the 26-year-old man were passengers in a rideshare when the car was hit by a stolen 1996 Honda Accord. The rideshare driver, a 28-year-old Santa Clara resident, is also being treated at a local hospital, according to a Santa Clara Police Department news release.

The suspect, 32-year-old Claudio Perez of San Jose, has been booked into the Santa Clara County jail on charges of murder, auto theft, driving under the influence, evading police and probation violations.

Perez received treatment at a hospital for minor injuries before he was booked into jail.

The driver hospitalized after last month’s crash that killed Broward Sheriff’s Office deputy Benjamin Nimtz was arrested Wednesday on 13 charges and citations Wednesday in relation to the crash.

The charges accuse Boynton Beach resident Darran Johnson, 32, of running a red light and speeding while not being sober and not having a valid driver’s license at the time of the July 21 crash at Military Trail and Southwest 10th Street in Deerfield Beach.

Johnson was charged with one count of vehicular homicide; DUI cause death and fail to give info; DUI cause death to any human; three counts of DUI with damage to another’s property or person; three counts of reckless driving with damage to person or property; one count of driving with a suspended license, second offense; misdemeanor possession of marijuana; and tickets for running a red light and speeding.

His bond, according to online jail records, is $50,000.

Fresno Police identified the man they believe is responsible for causing a fatal crash in southeast Fresno Saturday night.

Gustavo Blanco, 21, was found to be under the influence and has been booked into the Fresno County jail on suspicion of vehicular manslaughter and driving under the influence causing death, both felonies, according to Lt. Bill Dooley.

Police said Blanco was the driver of a blue Chevrolet Cruz that blew through a red light and crashed into gray Toyota Tercel traveling southbound on Maple with two men inside.

The victim was identified by the Fresno County Sheriff’s Office as 40-year-old Shawn Milton. A passenger remained in critical but stable condition Sunday at Community Regional Medical Center, police said.

A woman accused of hitting and killing a Sandy Springs bicyclist Wednesday morning while driving under the influence of alcohol was denied bond during her first court appearance Thursday.

Antoinette Battle, 34, faces charges of driving under the influence, reckless driving and first-degree homicide by vehicle, Fulton County court records show. She was arrested after striking and killing Marten Bijvank, a 29-year-old cyclist who was riding his bike to work, Sandy Springs police said.

Bijvank recently graduated from Arizona State University with two degrees, his wife, Valentina Fiorillo, told Channel 2 Action News. Starbucks, his employer, paid for his tuition, she said.

He was riding south on Roswell Road sometime before 5 a.m. when he was struck by a Chrysler sedan driven by Battle, said Sgt. Sam Worsham, spokesman for Sandy Springs police.

The vehicle came to a stop about 100 yards up the road and Battle was taken into custody shortly after officers arrived to the scene. The impact of the collision broke Bijvank’s bike in half and shattered Battle’s windshield.

Murder charges were filed Wednesday against the Santa Maria man who killed two women during what prosecutors claim was a fatal DUI crash March 16 near Donovan Road and Miller Street.

Along with two counts of murder, Javier Artemio Cortes was charged with one count of driving with a blood alcohol level above California’s 0.08% limit, according to the Santa Barbara County District Attorney’s Office.

Cortes pleaded not guilty and denied all special allegations — that he drove at an excessive speed, had a blood alcohol level more than twice the legal limit, and caused great bodily injury to multiple people — during his arraignment in Santa Barbara County Superior Court on Wednesday.

Free on bond since March 25, Cortes was remanded to Santa Barbara County Jail at the conclusion of a bail review hearing, where Judge Patricia Kelly, who presided over both matters, increased bail for the 27-year-old Santa Maria man to $2 million.

The charges come more than three months after Atascadero residents Madison Elizabeth Coleman, 17, and Monica Gonzalez, 20, were killed in the crash.

Santa Maria police officers responded at 3 a.m. to reports of a collision near the intersection of Donovan Road and Miller Street.

Upon arrival, they found that Cortes’ black car had slammed into the driver’s side of a vehicle carrying four people.

Two of the occupants, later identified as Coleman and Gonzalez, were pronounced dead at the scene.

Passengers Kimberly Olivo and Makayla Angelique Everhart, who were in the vehicle with Coleman and Gonzalez, also were injured in the crash.

Cortes was arrested that morning on suspicion of DUI and vehicular manslaughter. According to the complaint, Cortes had a blood alcohol level of 0.17% at the time of the crash.

The case is being prosecuted by Deputy District Attorney Madison Whitmore.
