Josiah Chandler shot the White man because he was White.

A Lockport shooting charged as a hate crime involves a black teenager accused of shooting a white man, Police Chief Lawrence M. Eggert said Saturday.

Josiah J. Chandler, 18, of Genesee Street, is due for a preliminary hearing Monday in City Court, when more information about the charges is expected to be released.

Details about why the incident was regarded as a hate crime will come out in court, Eggert said.

“It met all the criteria for a hate crime,” he said.

Chandler was charged Wednesday with attempted second-degree murder and other counts in the shooting of Colton Baker-Durst, 20, of Lockport.

“From what we could tell, it was a street altercation,” Eggert said. “It was not random.”

He said that the two men apparently did not know each other.

He shot Josiah J. Chandler in the back, where he is still in intensive care.

Baker-Durst was shot several times with a pistol about 12:25 a.m. Wednesday at Church and Green streets, Eggert said. The victim was listed in critical condition in Erie County Medical Center after the shooting.

Hospital officials said Saturday that the victim’s family had asked that no further information be released about Baker-Durst’s condition.

Eggert said Baker-Durst is in intensive care and that ECMC had promised to call police if there was any change in his condition. He said no such call has been received.

Chandler is being held in lieu of $250,000 bail set at his arraignment Wednesday by City Judge William J. Watson.

State law says a hate crime is one in which the criminal selects a victim or commits a crime “in whole or in substantial part because of a belief or perception regarding the race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation of a person.”

If a person is convicted of a hate crime, the potential sentence is increased from what it would be under normal circumstances.

For example, if Chandler were to be convicted of attempted murder as a hate crime, the minimum sentence would be eight years in prison instead of the normal five-year minimum for a “regular” attempted murder. The maximum term would be 25 years in either case.

Any murder conviction carries a maximum penalty of life in prison, but the minimum for a hate crime murder is 20 years instead of 15 years for a “regular” murder.

Josiah Chandler has been charged with attempted murder as a hate crime.

An 18-year-old man pleaded not guilty to shooting another man three times in the back. Josiah H. Chandler, 18, is charged with shooting Colton Baker-Durst, 20, overnight in Lockport. Chandler is facing a hate crime charge, because police said there were racial comments made to the victim.

Police said Baker-Durst’s friend was with him at the time of the shooting and witnessed the incident.

They said they recovered the gun at Chandler’s home and also took clothing as evidence.

Police said Chandler was taken in for questioning and admitted to the shooting.

Lockport Police Detective Captain Brian Wentland said they were called to the scene around 12:30 a.m. Officers found the victim near the intersection of Green and Church Streets. Paramedics flew him to Erie County Medical Center, where he is listed in critical condition.

Chandler was arrested within a few hours. He is charged with second-degree attempted murder as a hate crime, first-degree assault, second-degree criminal possession of a weapon.

LaJ-on Chandler, the suspect’s oldest sister, said they come from a racially mixed family. She said her brother was a star athlete at Lockport High School and planned to go to Erie Community College.

Lockport Mayor Anne McCaffrey said, “We are certainly cognizant of the racial tension in the nation right now with the Ferguson issue. It’s something we’re aware of, but we urge the community not to jump to any conclusions at this time, as the details are coming out about the crime.”

McCaffery said her city is constantly working to improve racial relations.“We’re a small community,” she said. “We all know each other and we all try to work together to meet the challenges that we face.”

Chandler is being held on $250,000 cash or $500,000 property bail. He appeared with hands and feet shackled before Lockport City Court Judge William Watson.

Mayor McCaffrey said people are feeling upset for the victim. “Our hearts go out to that family for the tragedy that they’re dealing with, she said.  She believes the community will “stay strong in light of what’s happened.”
