Jury selection has begun in the trial of a Massachusetts teenager accused of raping and killing his math teacher.

Philip Chism was 14 when he was charged in the 2013 death of 24-year-old Colleen Ritzer, a teacher at Danvers High School. He is being tried as an adult.

Jury selection began Wednesday in Essex Superior Court in Salem.

Ritzer’s body was found in woods near the school. Prosecutors say her throat had been slit with a box cutter.

As a Salem judge considers whether to suppress accused killer Philip Chism’s confession in the death of teacher Colleen Ritzer, his lawyers say they’re considering mounting a so-called insanity defense.

Chism’s attorneys also planning to ask that the trial, now set for Oct. 7, be moved out of Essex County, his lawyer said in court.

Chism, now 16, is charged in the Oct. 22, 2013 rape and murder of Ritzer, 24, of Andover. Police say he attacked Ritzer inside a girls’ bathroom at Danvers High School and then in a wooded area near the school, where her body was found early the following day.

Salem Superior Court Judge David Lowy said he could rule as early as Friday on a motion seeking to suppress Chism’s confession to police, deciding whether the teen understood what he was doing when he agreed to speak to investigators at the Topsfield and Danvers police stations shortly after he was found walking alone on Route 1.

Chism’s lawyers said he did not. Police coerced him into talking they said, ignoring what they contend is his mother’s request for a lawyer (something prosecutors argue she did not have standing to request) and Chism’s initial reluctance to speak.

“What the commonwealth is asking the court to do is violate the Fifth Amendment,” argued John Osler, one of Chism’s three lawyers.

Eager to talk?

But prosecutor Kate MacDougall said it’s clear that Chism did understand — and that he was actually eager to talk.

“They have someone who seems willing to talk,” said the prosecutor. “He had his story to tell, he was going to tell the parts he wanted to tell and not tell them the parts he didn’t.”

The judge seemed to share that view.

Referring to a video that remains under seal while Chism’s attorneys appeal to the Supreme Judicial Court to block its release, Lowy said Chism told police that Ritzer used a “trigger word” that set him off while the two were in the girls bathroom.

But Chism refused to say what that word was, the judge noted. “I don’t know how many times the defendant (was) asked,” said Lowy to the prosecutor. “I didn’t count them. Perhaps you did.”

MacDougall said Chism was asked at least three times, and also was offered the opportunity to write it down. But he refused, and it’s not clear that investigators have any idea what that purported “trigger word” was.

A Massachusetts teen charged with raping and killing his high school math teacher had a bloody box cutter and women’s underwear in his backpack when he was detained, according to two police officers who testified at a hearing Friday.

Philip Chism, 15, has been charged as an adult with murder and aggravated rape in the October 2013 slaying of Colleen Ritzer, his 24-year-old math teacher at Danvers High School IN Danvers, Massachusetts.

Topsfield Officers Neal Hovey and Joseph DeBernardo said in court that they found Chism on a poorly lit stretch of a roadway carrying Colleen Ritzer’s ID and credit cards.

They were responding to reports of a suspicious person on the road.

After bringing Chism back to the police station, Hovey said they found the box cutter and panties in his backpack.

This as Chism’s public defender, Denise Regan, is expected to argue in Essex County Superior Court on Friday that police never properly read Chism his Miranda rights and continued to question Chism even after he had invoked his right to remain silent and his mother had asked for a lawyer.

Regan’s legal brief argues police pressured Chism’s mother into helping them get a confession out of her son while he was handcuffed in a police interrogation room.

Prosecutors allege in previous court filings that on Oct. 22, 2013, Chism followed Ritzer into the girl’s bathroom after school, raped her and ‘repeatedly asphyxiated her before or while assaulting her with a box cutter.’

They said Chism put Ritzer’s mutilated body in a recycling bin and dumped it in the woods, positioning her with a tree branch sticking from her genitals and left it for authorities to find, according to court documents.

A Massachusetts teenager charged with killing his teacher last year after following her into a bathroom similarly followed a worker at a youth detention facility into a locker room last month before choking and beating her, prosecutors said Wednesday.

Philip Chism, 15, made sure he wasn’t being watched, took off his footwear to muffle his footsteps, then crouched down as he made his way along a corridor before following the 29-year-old woman into the locker room at Metro Youth Services facility in Boston on June 2, prosecutor Mark Zanini told a judge in Boston Juvenile Court.

Chism, with a pencil in his hand, pushed the woman against the wall in the bathroom, choked her, and then hit her in the head with his fists, he said.

“The victim was trying to scream but it was ineffective because her airway was closed by virtue of the defendant’s strangling her,” Zanini said.

After getting Chism’s hand off her neck, she screamed and other facility workers pulled Chism away from her, Zanini said.

She suffered injuries to her face, jaw, neck and back, and got a hole in the back of her shirt that was the same size as a pencil, which was found on the floor, Zanini said.

Chism was being held at the facility without bail after pleading not guilty to killing Danvers High School math teacher Colleen Ritzer in October. The Ritzer family released a statement on Wednesday after the details were released.

“Our thoughts are with the victim of this most recent attack, her family and loved ones. We find it unconscionable that a juvenile charged with such a heinous crime is afforded the freedom to roam the facility in which he was incarcerated, a luxury that enabled him to attack another young woman. This attack was preceded by clear warnings from prosecutors that he is a very dangerous individual,” the Ritzer family said in a statement.

The statement continued: “Any individual who repeatedly commits such violent acts should be confined in a way that those around him are not put at risk. Victims and their families should, at the very least, be comforted by some degree of security knowing that such individuals are securely locked in a cell and closely monitored. This case reinforces our belief, as a matter of public safety, that ‘juvenile offenders’ who commit such heinous crimes must be imprisoned for life with no opportunity for parole.”

Chism, who was 14 at the time, had recently moved to Danvers from Clarksville, Tennessee. He has since been moved to a different detention facility.

He was ordered held on $250,000 bail in the attack on the youth worker on charges of attempted murder by strangulation, assault with intent to murder, kidnapping, and two counts of assault and battery with a dangerous weapon.

The handcuffed Chism hung his head throughout the proceeding and did not speak other than to say “yes” when the judge asked him if he understood that he was not allowed to have any contact with the worker or any witnesses in the case. He didn’t enter a plea. His mother was also in court.

Chism is being charged as a youthful offender in the Boston case, meaning the proceedings in juvenile court are open and expose him to potential adult penalties.

Chism’s attorney, Denise Regan, did not challenge the bail or conditions of bail. She asked that her client be excused from his next scheduled court appearance on Sept. 19 because of the stress it causes him.

Court documents say a Massachusetts teenager charged with killing his math teacher appeared to be “psychotic” after he allegedly attacked a female clinician at a Department of Youth Services detention center in Boston earlier this month.

According to the petition to have Philip Chism committed to Worcester Recovery Center and Hospital for 30 days of evaluation and treatment, the 15-year-old was “out of touch with reality” and “yelling, screaming incoherently (and) foaming at the mouth while being restrained by staff.”

The details were released Tuesday by a Superior Court judge in response to a motion by The Salem News.

Chism pleaded not guilty to robbing, raping and killing 24-year-old Danvers High School teacher Colleen Ritzer after following her into a restroom last October. He was 14 at the time.

He is probably going to be granted ‘insane’ status, and be sentenced only to a few years in a medical facility.

A 14-year-old boy last month allegedly raped Danvers High School teacher Colleen Ritzer before murdering her and dumping her body in a nearby wooded area, prosecutors said today. Philip D. Chism was indicted by an Essex County grand jury today on charges of first-degree murder, aggravated rape and armed robbery, according to Essex District Attorney Jonathan Blodgett’s office. Chism allegedly attacked Ritzer when she stayed after school to talk with him about an upcoming exam, according to prosecutors and students who were in the building that day.

“The indictments returned today detail horrific and unspeakable acts,” Blodgett said in a statement. “This is the first step in a long process to secure justice for Ms. Ritzer and her family.”

Chism is facing the murder charge as an adult. He was indicted as a youthful offender on the rape and armed robbery charges. The latter charges will initially be handled in Salem Juvenile Court, but prosecutors said they “would move to join these indictments with the murder indictment in Superior Court.”

Chism allegedly sexually assaulted the victim with an object. The aggravated rape charge is brought when there was serious bodily harm or when the rape was committed during another violent felonious crime or both, prosecutors said.

Prosecutors also allege that Chism, armed with a box cutter, robbed the victim of credit cards, an iPhone, and her underwear.

Denise Regan, Chism’s court-appointed defense attorney, declined comment.

“We are devastated and heartbroken by the details of the horrific circumstances surrounding the death of our beautiful daughter and sister, Colleen,” the Ritzer family said in a statement issued by a spokesman. “As a family, we continue to mourn Colleen’s passing and ask that the media respect our privacy during this very difficult time.”

Students at the high school were shocked by the allegations. Some recalled Chism as a quiet student, who mostly kept to himself but did not show signs that he was capable of violence.

“It’s unreal that [Philip] would do something like that,” said Jessica DiPietro, 14, a freshman who had a math class with Ritzer.

“It’s unbelievable,” she added. “I can not even process into words why he would do something like that. It’s devastating.”

The new charges marked a legal milestone in the prosecution, but prosecutors did not provide any insight into what might have allegedly motivated a teenager who was developing a positive reputation in his new high school to suddenly turn on the 24-year-old Ritzer, a popular and enthusiastic math teacher.

An Essex County prosecutor stressed during a recent court hearing that there was no evidence that Ritzer engaged in any wrongdoing.
