Dublin dad, Brendan McDonagh, has been told he should pack a bag and prepare to be jailed over a cabin he erected on land his family owns without planning permission.

McDonagh, who has a wife and two children under ten, told Gript he has now been fighting for eight years with South Dublin County Council in order to try and satisfy the planning authority that the cabin is compatible with their standards.

The council claims that the cabin is not in keeping with its development plans for the area insofar as it “does not adhere to regional planning guidelines” and that “granting retrospective planning permission would set an undesirable precedent” as well as leading to a “demand for uneconomical provision of services in the area”.

Speaking to Gript today, McDonagh explained that, although he was formally self-employed, in order to try and secure a home for his family he voluntarily gave up this status and reduced his working hours to be able to qualify for HAP as he was unable to afford private housing on his former earnings.

Describing the average cost of rent in Dublin which is currently around €2,400, he said, “That’s a whole salary for somebody after they pay their taxes.”

“You just get one wage, and then you’re relying on the other person to run the cars and the food and the bills out of their wage. Yeah. So it’s not feasible.” he said.

He said that while he was self-employed he “wasn’t entitled to anything” in terms of help with housing or the cost of living.

He said he “can’t comply with a court order” to remove the cabin when the council has not offered him accommodation for his family, adding that although a number of SDCC councillors – including Independent Ireland Cllr. Linda DeCourci who told Gript she would be at the High Court to support him – had expressed their support for him that there had been no change from the planning authority.

Independent TD Mattie McGrath has called on the government to use a statutory instrument to give an amnesty to people like the McDonagh family who are relying on cabins and mobile homes – installed without planning permission – as housing in the midst of the housing crisis.

McGrath has called on his amnesty to be given for a period of up to ten years saying that there are many such people living in Ireland who are waiting to be “pounced on” by the local authorities.

McDonagh said that because he has not removed the remains of the cabin – which he gutted – off the land owned by his family, his barrister advised him to “pack a bag” and prepare to be sent to jail tomorrow from the hearing of his case before the High Court.

“I don’t want to bring the kids in, because then they’ll have memories of Daddy getting locked up, you know, or being threatened,” with jail.

But when they came to register the birth five weeks later they were shocked to discover she had been listed as male on her birth certificate due to a blunder.

Grace admitted she reviewed the certificate at the time but overlooked the mistake and signed it, attributing her oversight to a lack of sleep as first-time mum.

But they have so far been unable to amend the error on five-week-old Lilah’s records – despite getting in touch with national registration bosses.

Grace, of Kirkby-in-Ashfield, Notts., said: “It’s been a nightmare and I’ve not stopped crying since.

“As first-time parents, we were very excited and, admittedly, a bit overwhelmed – especially due to the lack of sleep.

“We focused on ensuring that all the names were spelled correctly and didn’t expect such a professional error to happen.

“At the moment our newborn daughter is a male according to the government. I don’t have a son, I have a daughter.

“This could cause significant issues for our daughter throughout her life, as it would imply she is transgender when she is biologically female.

“If she chooses to identify differently later in life, that is her decision. But at just five weeks old, she cannot make that choice.

“It’s unfair for her birth certificate to say male, which could negatively impact her in various aspects of life, such as school, jobs, and relationships – due to a mistake that is not her fault.

“We feel wronged by the system regarding this error, and the only way to properly address it seems to be by bringing it to parliament’s attention.

“What will happen when she applies for a passport, or a job and gets married?

“We do not feel like we’ve been treated fairly. She’s been failed by the system already and she’s only a few weeks old. I’m devastated.”

The mistake happened when the pair went to register Lilah’s birth at Sutton-in-Ashfield Registration Office in Nottinghamshire last Wednesday (13/11).

Grace and Ewan were informed that in order to rectify the mistake, they would need to pay £99.

Grace said she is concerned even after correcting the error, the birth certificate would still list Lilah as male, with a small note indicating the sex was changed to female.

The European Commission announced on Thursday that it is approving the use of the controversial chemical substance glyphosate across the European Union for another decade after member states failed to reach an agreement.

“The Commission, based on comprehensive safety assessments carried out by the European Food Safety Authority (EFSA) and the European Chemicals Agency (ECHA), together with EU Member States, will now proceed with the renewal of the approval of glyphosate for a period of 10 years, subject to certain new conditions and restrictions,” it said in a statement.

“These restrictions include a prohibition of pre-harvest use as a desiccant and the need for certain measures to protect non-target organisms,” it added.

The EU executive was granted the power to approve its own proposal after experts from member states on Thursday morning failed, for the second time, to reach a qualified majority in favour or against the plan first presented in September.

This came after the EFSA said in a July assessment that it had found “no critical areas of concern” for the renewal of use beyond 15 December, when the current five-year approval was due to expire.

The decision to use glyphosate at the national level remains, however, in the hands of each individual government.

No EU country has a blanket ban on glyphosate although some, including Austria, France, the Netherlands, Belgium, Luxembourg and Germany, have rolled out partial bans by prohibiting its use in certain areas or by households.

‘Alarming evidence’Glyphosate is a herbicide introduced in the 1970s and used to eliminate weeds that invade agricultural crops and public spaces. It has been a source of controversy since the World Health Organization’s cancer agency concluded in 2015 that it was probably carcinogenic to humans.

The Commission reiterated in its latest communiqué that the EFSA screened 16,000 published studies, 2,000 of which were considered potentially relevant, as well as 300 additional studies brought to its attention during the public consultation phase to deliver its assessment.

But NGO Pesticide Action Network said that the Commission’s plans to renew approval on its own would breach the EU Pesticide Law which states that a precautionary principle must be observed when there is no clear scientific consensus over a policy suspected of carrying risk of causing harm to the public or the environment.

“We regret that the Commission turns its back to independent science and citizens’ concerns and plans to re-approve this dangerous herbicide for another 10 years,” Angeliki Lysimachou, Head of Science and Policy at Pesticide Action Network Europe, said.

“There is alarming evidence highlighting the cancer risks associated with glyphosate, along with the myriad of other reported adverse effects,” she also said.
